Negative balance. Because you can account for transaction fees even if a transaction is declined, a rejected transaction may result in a negative account balance and an overs and a fault in your account. It is also possible to have a negative account balance if a cheque negotiated on your behalf by a network location conext loads your card and does not delete it or is returned as a dishonourable review. We will not extend the credit if, if your card account is in excess, you agree to pay us the excessive amount immediately without further request. We can deduct all negative balances from current or future balances on your card account or any other card account linked to the account holder. If your card account has a zero or negative balance, we may, at our choice, suspend or terminate your card account and all other cards related to the account holder without notice and/or track the collection of a negative balance, plus all collection fees, including legal fees. What Schieds is. Arbitration is a means of resolving a dispute between an independent third party. A “dispute” is any request or controversy between you and us. The concept of litigation must give its broadest meaning and includes, without limitation, all claims or claims (past, present or future, including events that occurred before your card application and if a card is made available to you, on the basis of a legal or fair theory (contract, illegal act or other) and regardless of the type of discharge requested (i.e. money, assistance or declaration). Litigation includes, for example and without restriction, all claims based on a federal or regional constitution, a law, a regulation, a regulation, a regulation or a common law, as well as any questions relating to the validity, applicability or scope of that arbitration agreement.
The card for bank transfers. You can make transfers that do not exceed the available balance of your card account. If a transfer is greater than the account balance, the booking is refused. Once your bank account has been registered to your CONEXT Card account, a bank transfer card can take between 2 and 7 days. Conciliation agreement. You and we (defined below) agree that all disputes (defined below) should be resolved through arbitration, unless we decide not to rule against arbitration by filing a first action before a competent court. This conciliation agreement is governed by the Federal Arbitration Act, 9 U.S.C No. 1 and following, and the material law of the State of Minnesota (without the application of its rules of choice).
Definitions. In this agreement, the terms “you” and “your” or “cardholder” are account holders, any primary card holder, any secondary card holder of the card and any heir, guardian, personal representative or agent in the bankruptcy of the above. “We,” “we” and “our” refers to the bank and includes employees, executives, members, directors, lawyers, related companies, predecessors, successors and divestitures, as well as marketing, service and collection representatives and representatives of the above. “Bank” means Sunrise Banks, N.A., the issuer of the card. “program manager,” mercury Service Group, LLC, the bank-authorized service provider for the CONEXT program® Visa® prepaid card and its successors, related company or agent. Any card or card account request is processed by the program manager acting on behalf of the bank.
